Com. M. Krishnan, Secretary General, National Federation of Postal Employees (NFPE) & Confederation of Central Govt. Employees & Workers, General Secretary, All India Postal Employees Union Group-C (CHQ), Leader, JCM Departmental Council, Department of Posts, Member, JCM National Council will be retiring from service on superannuation on 31st August, 2014.
                   As per the decision of NFPE Federal Executive meeting held on 21-08-2014 and Central Working Committee meeting of AIPEU Group-C (CHQ) held on 22nd to 24th August, 2014 at Ongole (Andhra Pradesh) Com: M.Krishnan, will continue to function in the NFPE & P-3 CHQ till next Federal Council of NFPE (May 2016) and All India Conference of AIPEU Group-C (June 2015).  He will also continue to lead the entire Central Government employees as Secretary General, Confederation till the next National Conference (2016).
                   Com: R.N.Parashar, Asst. Secretary General, NFPE, will take charge as Secretry General, NFPE from 01-09-2014 till next Federal Council as per the decision of NFPE Federal Executive meeting.  Com.N.Subramanian, Deputy General Secretary, AIPEU Group-C (CHQ) will officiate as General Secretary, AIPEU Group-C (CHQ) till next AIC, as per the decision of CWC meeting of AIPEU Group-C.
                   NFPE CHQ, AIPEU Group-C (CHQ) and the CHQs of all other affiliated unions of NFPE extend our best wishes to Com.M.Krishnan and we are sure that he will lead us in the coming days also.
                   We are reproducing below the resolutions adopted by NFPE Federal Executive meeting and Central Working Committee meeting of AIPEU Group-C on the services rendered by Com.M.Krishnan.  We are also reproducing a letter received from Shri.D.Theagarajan, Secretary General, FNPO.
I.  RESOLUTION ADOPTED BY NFPE FEDERAL EXECUTIVE.
            The Federal Executive of NFPE records its full appreciation for the yeoman service rendered by Comrade M.Krishnan as the Secretary General of NFPE. The Federation has scaled new heights during his stewardship and the unity of Postal regular employees and Gramin Dak Sewaks entered into a new chapter under his leadership. The united movements of Postal Workers under the banner of Postal JCA as well as the independent struggles under the mighty National Federation of Postal Employees are further strengthened under his able leadership. He provided a militant, progressive leadership with farsightedness for the betterment of Postal Workers. It is  under his leadership that the NFPE claimed its historic vanguard role of leading the entirety of CG Employees under the platform of Confederation of CG Employees & Workers and it can be seen that the movement of central government employees has launched a powerful movement including strikes for the establishment of 7th CPC with Comrade M.Krishnan as its Secretary General. The integration of Postal and CG Employees with the entirety of Indian working class organisations in developing the path of united struggles against the neo-liberal policies of Government has further been cemented during his tenure. The leadership of confederation has come back to the Postal Organisation after a long period of 44 years and comrade Krishnan is leading the movement of CG employees in the path of struggle with firmness and it is noteworthy to mention that the unity of all JCM National Council organisations has reached its zenith with all coming together in championing the cause of three lakhs of Gramin Dak Sewaks and thousands of casual labourers in Postal and CG services due to his firm efforts. Ideological education of all cadres and employees through several All India and Regional Trade Union Camps under the banners of NFPE and Confederation; Concrete organisational steps for mobilizing the women employees of Postal Department as well as the Confederation level are some of the landmark achievements of Comrade Krishnan. The National Executive notes with happiness that all the affiliates of NFPE have always maintained a unified stand on all important activities of the Federation and this unity is due to the confidence created amongst all affiliates by the unifying leadership of Comrade Krishnan. The relinquishing of charge as the Secretary General of NFPE by him due to his superannuation from the Government Service is a huge loss to the movement but the Executive wishes to get his valuable advice and guidance to the Federation in the days to come. The National Executive places on record its unstinted gratitude to Comrade M.Krishnan for his able leadership to the historic organisation of NFPE not only as Secretary General but in numerous other capacities as well during his long service.  The Federal Executive further resolves that Com.M.Krishnan will continue to be in the Federal Executive of NFPE even after handing over charge, till the next Federal Council meeting to be held in May 2016.
II.          RESOLUTION ADOPTED BY CWC MEETING OF AIPEU GROUP - C (CHQ)
                   RESOLUTION ON THE SERVICES OF COM. M.KRISHNAN, GENEARL SECRETARY, AIPEU GROUP-C CHQ & SECRETARY GENERAL NFPE/CONFEDERATION
            The Central Working Committee of All India Postal Employees Union Group ‘C’ (CHQ) held in Ongole (Andhra Pradesh) from 22.8.2014 to 24.8.2014 unanimously appreciates the sincere, superb and outstanding services rendered by Com. M. Krishnan as General Secretary of AIPEU Group ‘C’ (CHQ) and Secretary General of NFPE & Confederation during his tenure and like to place on record our whole hearted compliments,greetings and commendations to him and also acknowledge and recognize him for his unparalleled and appreciated service, which definitely resulted in charming the organization to new heights and also in settling many of the long pending demands of the Postal employees, especially Postal Group ‘C’ staff.

Com. M. Krishnan’s contributions in enhancing the prestige and image of AIPEU Group ‘C’ and thereby NFPE as well as the Confederation, will be remembered forever. In order to strengthen the organization and also to enhance the organizing capacity of the rank and file leaders the P3 CHQ  & NFPE CHQ under the leadership of Com. M. Krishnan is maintaining constant communication with the general membership through website and also the Bhartiya Post and Postal Crusader monthly journals. The Trade Union classes and workshops organized by Com M.Krishnan, General Secretary for the NFPE and the Confederation has also contributed to a great extent in improving the quality of the organization. The need of the unity amidst the working class of all sections as well as Government employees, organized and unorganised workers, he preached and also practiced during his tenure upsurge him to the  standard of a great statesman and a living legend. It is only Com M. Krishnan, who spends more than 20 hours daily for the working class all along during his tenure.

Com. M.Krishnan is a vivacious, vibrant,meticulous hard working and fully committed leader and is always working for the upliftment and welfare of the Postal employees, especially most down-trodden three lakhs Gramin Dak Sewaks. He has also extended his helping hand to all affiliated unions of the NFPE as the Member and then Leader of the JCM (Departmental Council) Staff side. He is also the All India Secretary General of the Confederation of Central Government Employees & Workers and is at the forefront in implementing all the programmes of the Confederation. The two days strike in February 2014 demanding the formation of the Seventh Pay Commission cut the ice and is one of the milestone in the history of the CG employees’ movement.

Com M.Krishnan has pioneered and crusaded his best in making the General Strikes conducted as per the call of Central Trade Unions and other Federations including NFPE against the anti-people and anti-worker policies of the Govt. a grand success in the Postal Sector. As the Secretary General, National Federation of Postal Employees he built the unity of all the Postal employees and conducted various trade union actions which have prevented the adverse effect of implementation of the new economic policy in the postal sector and to save the postal service as a public utility service. The mass recruitment to the extent of 30% and more in the postal is the major advancement of the Federation for which the skill and negotiating capacity of the Secretary  General NFPE Com M. Krishnan are fully exploited. The fight against closure of 9797 Postoffices and 300 RMS offices in the name of McKincey Consultancy’s recommendation, the campaign against the New Postal Policy and the move of the Govt. to privatise postal services by granting licence to Courier Services, the Cadre Restructuring agreement etc are examples of his uncompromising stand, hard-bargaing and negotiating skill. His capacity to make inspiring and educative speeches and also taking class are worth emulating.

This Central Working Committee of this Union, while saluting Com. M. Krishnan for his devoted and dedicated service to the Central Govt. Employees and Postal employees, especially to the CHQ of AIPEU Group ‘C’ hereby resolved to utilize the valuable and experienced services of Com. M. Krishnan in the AIPEU Group ‘C’ (CHQ) till the next All India Conference to be held in June 2015.
III.  E.MAIL RECEIVED FROM SHRI.D.THEAGARAJAN, SG, FNPO.
In regard to the services rendered by Sri M.Krishnan to the employees, I am unable to find words to express my appreciation towards him. In the last few years my relationship with him is very cordial and it became useful to the Postal employees.  His manner of approaching official side with the issues of staff is bold as well as of positive nature .
So far I do not find negative attitude in him during the negotiation with official side. The retirement of Shri  M.Krishnan from the Department is a great loss to the Postal employees in particular and  central government employees  in general .
In fine , I feel that a good friend of mine is retiring from the service.. I pray to  the Almighty to shower blessings on him and his family members to give happiness and prosperity .

Reg : Payment of Interim Relief and Merger of Dearness Allowance with Pay.

The Staff Side of National Council (JCM) , had raised the issue regarding payment of interim relief and merger of dearness allowance with pay , as an Agenda Item of the Standing Committee of National Council (JCM ) in its meeting held on 7th May, 2014.

After detailed deliberations , it was stated by the Secretary (Expenditure), Ministry of Finance on this item that since the terms of reference enables the 7th CPC to send Interim Report , as such, the Staff Side might approach the Pay Commission for a report on Interim Relief and Merger of Dearness Allowance, as recorded in the Record Note of meeting, forwarded to Staff Side vide Director(JCA), Government of India, Ministry of Personnel, Public Grievances and Pensioners , Department of Pension and Pensioner’s Welfare ‘s letter No. 3/9/2014/JCA dt.24/7/2014.

We, therefore, humbly request you to kindly favourably consider our demand of payment of Interim Relief and Merger of Dearness Allowance with pay as Dearness Allowance, has since crossed the value of 100% on 1st January, 2014 and a number of Government Employees are superannuating every month,who would be deprived of the benefit of the same.

The President Com Radhakrishna welcomed the Chairman and Members of the 7thCPC for the meeting.
The General Secretary Com P.S.Prasad presented the power point presentation.
The interactions were held for about 50 minutes with the Pay Commission officials,
Com   Radhakrishna, Com P.S.Prasad, Com Muthukumar , Com Vinod, & Com Ramakrishna spoke effectively on various subjects.
The following items and points were presented:
Bangalore Prices:
It was brought to the notice of the commission that the cost of living is high in Bangalore compared to other metro cities in the country and the prices of all essential commodities are comparatively high in the State of Karnataka. House rent is in the range of  Rs 7000/- per month to Rs 35,000/- per month. The private school fees is from Rs 25,000/- to Rs 50,000/- per year.  Donation is also too high, the cost of local transportation is from Rs 2000/- to Rs 10,000/- per month.
(This was only informative portion on prices)

Minimum Wage:
It was brought to the notice of the commission that:
a)      Since Government is a model employer, they should provide minimum wages as per the 15 ILO conference and other wages as per the educational qualification & skill requirement of the job .
b)      Higher skill requirement due to computer usage and modernisation of equipment's. The skill requirement is higher compared to earlier days due to technology advancement.   
c)      The  higher inflation which is existing from the last eight years which is effecting the Government Employees, the money value has gone down to a large extent & there is erosion in wages.
d)      The salaries of the Government Employees are fully accounted for tax calculation, whereas in private sector allowances are not taxed.
(The commission Agreed to consider this on the lines of JCM memorandum)
It was brought to the notice of the commission that to attract higher talent to Central Government higher pay scales should be given.
(The commission was of the view that people choose their career on various aspects including wages.  Wages of Government employees cannot be compared with private sector.   It was pointed out by us that though the wages cannot be compared with private sector there is a need to keep the wages in central government that people will continue in government after joining.  Chairman assured to examine this aspect)

EQUAL PAY FOR EQUAL WORK

It was brought to the notice of the commission that in respect EQUAL PAY FOR EQUAL WORK
a)      For the same post which include similar duties and responsibility, there are different pay scales/ Grade Pay existing for same nature of duties and similar recruit qualifications.
b)      Grant of Grade Pay Rs.4800 to all Supervisors cadre.
c)      The gazetted Group “B” post be  started  from Rs 5400/- GP. 
d)      LDC pay scales should be provided with Grade Pay of Rs.2400 as their minimum qualifications is 12th std.
e)      There should not be any discrimination in the Pay scales of CSSS Cadre and Subordinate Departments since the nature of work being carried out by them is similar. Hence, disparity is to be removed.
f)        The Drivers of Subordinate offices  be placed with starting pay of Rs 2400/ GP as in Lok Sabha Secretariat.
g)      Graded structure for MTS should also be recommended as the 5th CPC vide para no 53.13 had recommended graded structure for these MTS.
h)      Pay scales of Stores wing persons be upgraded considering their work load and level of responsibility.
i)        Provide additional increment w.e.f. 01.01.2006 to staff working in old pay scale Rs.7450-11500 as in case of Inspectors of Central Excise and Income tax departments.
 (The commission positively agreed to consider this suggestion except Drivers case.)

Increment rate of 5% and Promotion policy.
It was brought to the notice of the commission that on Increment rate of 5% and Promotion policy.
a)      As the Government employee put more and more service, he will be more trained to perform his duties in a better befitting manner. Thus the Government is more beneficial as good quality of work can be expected from an experienced official.
b)      His family responsibility will increase with age.
c)      They has to educate the children in professional courses, marriage of his children has to be performed, his medical expenses will also increase.
d)      There should be adequate financial protection for him, the better rate of increment should motivate him to work more.
e)      The person joining a Central Government Service is not just for the employment is for a whole career.
f)       On promotion one shall get two additional increments subject to an minimum salary increase of Rs 3000/- per month as he will perform higher duties and responsibility's.
g)      He shall get not less than five financial up gradations in promotional hierarchy during his service to motivate him to work more.
h)      Similarly the scientist are provided to FCS and get promotions every 4 years.
(The commission positively agreed to consider this suggestion.)

Consumer Price Index & Dearness Allowance Formula.
It was brought to the notice of the commission that on Consumer Price Index & Dearness Allowance  Formula.
a)      CPI as on 1/1/2006  was 115.76 points.
b)      CPI as on 1/1/2014  was 237 points.
c)      The CPI has increased by 121 points .
d)      But the DA increased by just 100% as on 1/1/2014 from 1/1/2006.
e)      The actual DA should have been 121 % not just 100% as on Jan 2014.
f)       Actual increase in price rise is more than 200 % and DA should have been more than 200%.
g)      6 months average DA computation of Consumer Price Index should be provided to Central Government employees rather than 12 months average.
h)      Rounding off DA be done whenever it crosses fraction more than 0.50
(The commission positively agreed to consider this  suggestion.)

Allowances:
It was brought to the notice of the commission that on Allowances
a)      All allowances such as HRA, Tour DA, CEA (tuition fees) , Cashier Allowances, etc. should be increased by four times.
b)      OTA & Night Duty to be paid on par with Railways .
c)      When ever there is an increase in Dearness Allowance, the above  allowances be also increase as in the case of Transport allowance.
(The commission positively agreed to consider this suggestion.)

Transport allowance:
It was brought to the notice of the commission that on Transport allowance
a)      The  field oriented organizations like CGWB, Survey Of India, GSI, IBM, IMD, etc. most of the categories remain in fields, even Postal Employees and AG's Employees  are effected.  
b)      Now the field going staff are deprived of earlier CCA and present Transport Allowance as they cannot fulfill the condition of at least one day stay in a month in head quarters.  
c)      This condition of being present at Hqrs. Office at least a day in a calendar month becoming eligible for transport Allowances should be removed.
(The commission positively agreed to consider this suggestion.)

Taxes:
It was brought to the notice of the commission that on taxes:
a)      The  Fifth Central Pay commission in its report vide para no105.12 has said that  Dearness allowance  be paid free of net taxes as the DA is paid for compensation against price rise. All other allowances should also be paid net of taxes which has been examined by 5th CPC in para no 167.
(The commission agreed to examine this suggestion.)

Health Care system:
It was brought to the notice of the commission that on Health Care system
a)      More CGHS hospitals should be made available or alternatively the person should have the option to choose any of the hospitals of his choice and the bill to be passed with AIMS rates.  
b)      Existing CGHS system needs improvement.
c)      Proper ward entitlement should be made as per grades.
d)      Cash less facility for hospitalization.
e)      Autonomous bodies shall also be included in CGHS
(The commission to examine this suggestion, but not satisfied with demand of Cash less facility for hospitalization.)
It was brought to the notice of the commission that on following issues.

Other points:
a)      Central Government Strength.
b)      Non-filling up of vacant posts has resulted in increased work load on the existing employees.
c)      Lower Spending by Central Government on its Employees.
d)      Leave / Holidays.
e)      12 days Casual Leave.
f)       Restrictions EL of  300 days to be removed.
g)      The PSU are providing reward medals after 15 years, 25 years and end of service, similarly such reward should be provided to Central Government Employees.
h)      In case of death of Government Servant during while on duties, his family members should get compassionate  appointment not considering restrictions of 5%.
i)        Education Loan should be provided.

Why do we join union?

Why do we join Union?

With the evolution of society and growth in social needs there is a sharp development in industrialization. It involves use of modern technology and employment of large number of workers. As large number of people are involved,  it becomes necessary to safe guard the interest of the workers. They need to be organized to fulfil their demands in respect of salary, welfare and social security. There comes the concept of `Union’. 

          So, union is the long-term association of workers to advance and protect the interest of members of the union in the working relationship. According to Flippo “A labor union or a trade union is an organization of workers formed to protect, promote and improve through collective action, the social, economic and political interest of its members.” 

          Whenever any employee joins a union, he has some expectations in his mind. He may join the union for the following reasons:- 
  
·          Economic benefits: When any employee joins an organization the main interest is the salary or wage. As the social status of a person is defined by the economic standard he carries, more emphasis is given to the economic benefits. But any single individual has very little bargaining capacity as compared to the huge power of the management. He thinks, if he joins the union, union will fight for the economic interest of the employee as the union has great bargaining capacity to get its demands accepted by the management.  But the union has also its own limitations. It can bargain on the genuine ground according to the prevailing rules. It can demand for the economic up-gradation when the organization is economically sound. For that the employees have to give their hundred percent so that union can demand enhancement of monetary benefits. Because no organization will give any economic benefit unless and until it is economically sound. At that time expectation of economic advancement is baseless. 

·          Platform for self-expression: At the primitive days of industrialization, lives of the workers were like slaves without any voice against the tyranny of the management. They used to live at the mercy of the management. They couldn’t raise their voice against un-hygienic working conditions, hard work, low wage, long and inconvenient hours of working etc. Self-expression and individuality were totally prohibited. But the desire for self-expression is a fundamental drive which can’t be ignored. By joining the union the employees get a platform for self-expression. The union provides the mechanism through which employees can make their voice heard by the top management. Union serves as the communicating device between the employees and the management.  Sometimes due to low perspective and narrow-mindedness, some can’t understand the long-term views taken by the organization in the context of overall growth of the organization and employees. Anything which does not result in immediate reward becomes unattractive to them. This attitude results in the difference in views and conflict in union. One thing we should keep in mind that union is by the employees, for the employees and of the employees. So to be in union, one should go beyond oneself. 

·          Check-bar on arbitrary action of the management: The employees join the union to fight against the arbitrary action of the management. It works like a brake to the monopoly of the management. Employees expect a just and fare dealing from the management on the basis of the prevailing rules and regulations. Union  serves a checkmate when management goes beyond the prevailing rules and take action against the employees which is irrational, unlawful or  discriminatory. Thus union safe- guards the interest of the employees. 

·          Security :  The employees join union because they think that at the time of need the union will stand by them. They can get the protection from hazards and economic insecurities at the time of illness, accidents, unemployment etc. For example, trade union ensures compensation to the injured workers under the Workman’s Compensation Act 1923, secures the retirement benefits under Gratuity Act 1972 and PF Act 1952, employees’ health, social security, payment of wage, bonus, insurance, maternity benefit etc. and other welfare measures by compelling the management to abide by these. With the union, employees feel safe and secure both mentally and physically. 

·          Employee-employer relationship:  The employee may not have easy access to the top management. But union is the proper machinery which maintains a sound communication between the employer and the employee. Employees feel attached to the organization by this. If the relation between the employer and employees is good then industrial disputes, conflicts, strikes and lock-outs can be avoided. 

·          Sense of participation: Sense of participation is also a fundamental desire among the employees. They expect that their voice should be heard in making decisions in the organization. This is known as the Workman’s Participation. Being in the union, they can make their voice heard by the management in matters affecting them and can also influence to take a correct decision. 

·          Sense of belongingness: When any employee joins an organization the sense of belongingness is developed inside him. He tries to feel that he is the integral part of the organization. For that he may join the union. Because his co-workers are with the union. He may have the feeling that if he will not join the union he will be odd man out and can’t get any assistance at the time of need. On the contrary, when he is in the union he feels that he is attached with the organization and experiences a feel-good factor. He begins to think that he has some importance in the organization and among the co-workers. 

·          Background factor: Some who are born and brought up in the industrial area or in the organizational background where the society members and members of the family are attached with the union, join the union as a nature of practice. Here the past history works. As a result,  they think it obvious and natural enough to join the union. 

Though it is the mere truth that union is for the safe-guard of the employees, we can’t use it as the weapon against the management. If management strives for the long term benefit of the organization which may sound unreal on the today’s back ground,  then union also has to think in that angle for the mutual benefit. We should aspire for the long term benefits because our next generation may get the fruit out of it. We have to make the union strong for the bright future.

The CHQ has received reports from various affiliaties to the effect that they have all endorsed the common memorandum, the Confederation had submitted to the 7thCPC. Most of the affiliates have emailed copies of the respective memorandum to the CHQ. Those who have not sent copies are requested to do so without further lossof time. This will enable the Confederation to write to the 7thCPC to provide an opportunity to these organisations to tender oral evidence to explain and elucidate their submissions in the memorandum.The meeting noted that there has been only negative response from the Government on the issues of Interim Reliefand merger of DA. We have already sent toyou a copy of our letter addressed to the Seretary, Staff Side, JCM National Council, (Com. Shivgopal Mishra) which is yet to beresponded. The meeting considered the following issues as important, the pursuance of which must not brook any delay, especially in the background that the 7thCPC has formally written to the Government asking it to indicate the course of action required to be taken on the memorandum of the staff side on Interim Relief and marger of DA.CHARTER OF DEMANDS1.Merger of DA with pay for all employees with effect from 01.01.2014 including Gramin Dak sewaks and pensioners.2.Grant of Interim Relief to all employees including Gramin Dak Sewaks and Pensioners.3.Inclusion of Gramind Dak sevaks under the purview of 7thCentral pay Commission.4.Scrap PFRDA Act and grant of statutory pension to all.5.Date of effect of 7thCPC recommendations should be 01.01.2014.6.Regularisation and revision of wages of casual laboures and contract workers.7.Removal of 5% condition for compassionate appointments.8.Fill up al vacant posts and creation of new posts wherever justified.9.Stop downsizing, outsourcing, contractorisation and privatisation of Government functions.10.Grant Productivity linked Bonus to all without ceiling; compute Bonus as weighted average of PLB for those not covered by PLB agreement.11.Revise OTA and NDA and implement arbitration awards.The meeting also considered the policy perception of the new Government in the light of the administrative price hike in petroleum products, the proposals in the Railway and General Budget, the steep hike in the freight and passenger fares of Railways, the decision to hike FDI in Defence Production, Railway Infrastructureand Insurance sectors, disinvestment of public sector including nationalized banks and have come to the inescapable conclusion that under Narendra Modi dispensation, the neo-liberal policies, as expected, will only be intensified and the promised “Achche Din” is for the Corporategiants of the country. The last session of the Parliament witnessed the determination of the NDA Government in changing the labour laws on the lines of the enactment made by Rajasthan Government of Vasundhara Raje Scindhia by virtue of which in almost 90% of the manufacturing units in India, the employers are permitted to indulge in hire and fire policy, for the existing regulations will be dispensed with.The meeting came to the decision that the confederation must organise serious and prolonged campaign, preferably in unison with the Railway and Defence Federations.We will pursue our consultation with thoseFederations to reach a common approach in the matter. Since it might take some more time, the meeting decided to pursue the demands through a demonstrative programme.Confederation office Bearers will meet again at Delhi on 26.09.2014, 5 PM to decide further course of action. Confederation will bring out pamphlets and bulletins to explain various issues like minimum wage, DA, Bonus, GDS problems etc. shortly as part of an education campaign. BCPC WRITES TO MINISTER SEEKING JUSTICE TO ALL PRE_2006 PENSIONERSLET US FIGHT FOR JUSTICE FOR ALL PRE-2006 PENSIONERSThe New NDA Government has taken a decision to implement the judgment on the contempt of court petition on the Pre-2006 Pensioners case only to the members of the petitioner pensioner organisations. It was intimated by the Government side during the hearing on 4thJuly, 2014 in Principal CAT that it will implement the decision to the petitioners. Subsequently a letter  has been addressedby the Government to those petitioner organisations asking the details of the members to enable the Government to implement the judgment to them only. This shows the mindset of the Government that it do not want to extend the benefit of judgment to all pre-2006 pensioners. This is a grave injustice to the pre-2006 pensioners' community which is more than 38 lakhs in numbers.At the same time the Government has filedanother petition on the same issue in the Supreme Court against the judgment of another court and that hearing is coming up on 16th September, 2014.BCPC has written to the Honourable Minister of State of Ministry of Personnel& P.G & Pensions of Central Government onthis matter and has demanded that all pre-2006 pensioners should get the benefit. While submitting the details of this case we also request you kindly to give us an opportunity to meet you to explain our request.2.         The facts of the case briefly stated are as under:-a).  The VI CPC in Para 5.1.47 of their reportrecommended that the fixation of revised pension as per the table given by them"will be subject to the provision that the revised pension, in no case, shall be lower than fifty percent of sum of the minimum of the pay in the pay band and the grade pay thereon corresponding to the prerevised pay scale from which the pensioner had retired".b).  The Government of India in their Resolution No. 38/37/08-P&PW (A) dated 29.8.2008 accepted the above proviso by reproducing it per verbatim at item 12 of the statement showing the relevant recommendations and decision of the Government thereon (vide Annexure the said Resolution).c).  In Department of Pension & Pensioners Welfare O.M  No. 38/37/ 08 P&PW dated 1.9.2008 same proviso has been incorporated at para 4.2 thereof.d).  The Department of Pension & Pensioners Welfare through their clarificatory O.M. No. 38/37/08 – P&PW (A)pt. 1 dated 3.10.2008 however modified thepara 4.2 of their OM dated 1.9.2008 as under:The pension calculated at 50% of the minimum of pay in the pay band plus grade pay would be calculated (i) at the minimum pay in the pay band (irrespectiveof the prerevised scale of pay) plus grade pay  corresponding to the prerevised pay scale"e).  In other words in all cases it would be minimum pay of the pay band which wouldbe taken and not the minimum pay in the pay band corresponding to the prerevised pay scale.f).  This clarification was challenged by theCentral Government SAG (S-29) Pensioners Association in Principal Benchof the Central Administrative Tribunal (videO.A No. 655/2010). This Hon'ble Tribunal intheir order dated 1.11.2011 quashed the above clarificatory order of Department of Pension & Pensioners Welfare dated 3.10.2008 and directed the respondents refix the pension of all pre 2006 retirees with effect from 1.1.2006 based on Government Resolution dated 29.8.2008.g). Government of India challenged  the above decision of the said Tribunal before Delhi High Court vide WP (C) No.1535/2012which was dismissed by the High Court vide their order dated 29.4.2013 upholding the decision of the Tribunal.Government of India then filed the following S.L. Ps etc.(i)  SLP (C) No. 23055/2013 dismissed on 29.7.2013(ii) Review Petition (C) No. 2492 / 2013 dismissed on 12.11.2013(iii) Curative Petition (C)No. 126/2014 dismissed on 30.4.2014Thus the CAT verdict dated 1.11.2011 attained legal finality.h).     On 15.5.2014 the Hon'ble CAT Principal Bench New Delhi disposed of thecontempt petition No. 158/2012 directing the Union of India to implement the directions of the Tribunal expeditiously, preferably within three months"3.            The Department of Pension & Pensioners Welfare in their letter No. 38/77-A/09-P&PW (A) dated 29.5.2014 written to the Secretary of Petitioner Association (Central Govt. SAG (S-29) Pensioners Association) has stated that as per the directions of Hon'ble CAT their order dated 1.11.2011 is required to be implemented "only in respect of Petitioners in O.A. No. 655/2010 and not in respect of all pre 2006 retirees as per the Tribunals order dated 1.11.2011. There is no such direction that it should be implemented only in respect of Petitioners. May be that Government Advocate had indicated that Government is willing to implement the judgment qua petitioners but the Tribunal had disposed of the contempt Petition by directing the Union of India to implement their directions dated 1.11.2011 expeditiously.4.            It will not be out of place to mention there that response to answer to Lok Sabha unstarred question No. 3406, the above directions of the CAT Principal Bench had already been implemented in respect of all pre 2006 retirees but from an arbitrarily fixed date of 24.9.2012 (vide Department of Pension & Pensioners Welfare O.M. F.No. 38/40/12- P&PW (A) dated 28.1.2013. It was not restricted to members of the Petitioners Association Accordingly the direction to implement it w.e.f 1.1.2006 has to be in respect of all pre 2006 retirees also.5.            Bharat Central Pensioners Confederation which is the apex body of all Central Government Pensioners Federations and All India Associations therefore appeal to you to ensure the correct delivery of justice by implementingthe above judgment of the Hon'ble Tribunal (which had attained finality) in respect of all pre 2006 retirees so that theyare not pushed to seek justice though multiple litigations.Thanking you,Yours faithfully,(S.K.Vyas)Secretary General

The Central Government has constituted the Staff Selection Commission to make recruitment by competitive examinations as well as by selection to Group ‘C’ (non-technical) posts in the Central Ministries/Departments and their attached/subordinate offices, except those posts which are exempt from its purview. The recruitment to other non- gazetted posts including industrial employees is being made by the organizations concerned which have to conform to the provisions in the recruitment rules for the respective posts. Recruitment to non-gazetted post in Railway establishments is done throughthe respective Railway Recruitment Boards under the Ministry of Railways. The action regarding filling up of vacant posts and for new appointments is taken by the concerned Ministries/Departments of the Government of India. On implementation of recommendations of 6th CPC, all Group ‘D’ posts in Central Government stands upgraded to Group ‘C’ posts and there is no further recruitment in Group ‘D’.(b): No, Madam.(c) & (d): In view of (b) above, question does not arise.

Branch/Divisional Circle SecretariesYour Attention Please.Procedure to be followed when taking up Branch./Divisional/Circle Level Cases at Directorate levelSome of the Branch/Divisional/Circle Secretaries are forwarding Divisional/Circle level cases to the CHQ by post and also by email, even without discussing the case with the Divisional/Regional/Circle Administration.  Whenever CHQ takes up any case of a Division/Circle at Directorarte level, it should clearly mention that the issue was taken up at Circle level and the reply given by the Circle Administration (written or oral) shall also be mentioned.Conducting monthly meeting by Divisional head with Divisional Unions, Bi-monthly meeting by Regional PMG/DSP (HQ) with Circle Unions and JCM (Regional Council) meeting/Formal four monthly meeting by Chief PMG with Circle Unions at regular intervals is mandatory.  If these meetings are held regulartly at Divisional/Regional/Circle level, thenmost of the Divisional/Circle level items can be discussed with the administration and the administration is bound to give a written reply.  if any Divisional head is not holding monthly meeting everymonth, then the Divisional Secretary should taken up the case through Circle Union with Chief PMG for issuing instructions to the Divisional head.  If any Regional, PMG/DPS (HQ) is not holding Bi-monthly meeting every two months, the case should be taken up with Chief PMG through Circle Union for issuing instructions to the PMG/DPS (HQ).  If Chief PMG is not holding JCM (RC)meeting and formal four monthly meeting, then Circle Secretary should take up the case with CHQ      for issuing suitable directions from the Directorate to Chief PMG.  If Chief PMG is not ready to intervene in any case, that matter should be reported to CHQ with details of the cases taken up with CPMG.It is the responsibility of the Divisional/Circle Secretary to ensure that formal meetings (MM, BM, FM, JCM RC) are held regularly with the Divisional/Regional and Circle Administration.  Whenever any case is sent to CHQ, a mention should be made to the effect that the case is taken up with Circle Administration and such and such reply (either oral or written) is given.  If CPMG is not ready to discuss, it may be mentioned.CHQ will mention this fact in our letter to/discussion with Directorate.Normally Directorate willnot entertain Divisional/Circle level issues, unless a clear mention is made that the issue was taken up at Circle level but could not be settled and the stand taken by the CPMG is also mentioned.On behalf of the CHQ, I request all Branch/Divisional/Circle Secretaries  to follow the above procedure when you are taking up Circle/Divisional level cases at CHQ level.The above procedure is not applicable to general cases of All India nature.  Such cases can be taken up with CHQ, even without taking it up at Circle level.M. EDITORIAL POSTAL CRUSADER“WE SHALL OVERCOME”OBSERVE “WEST BENGAL SOLIDARITY DAY” ON 27.08.2014The National Secretariat meeting of the Confederation of Central Government Employees & Workers has given a nationwide call to observe “West Bengal Solidarity Day” on 27thAugust 2014 to express full support and solidarity with thestruggle of the people and working class of West Bengal including Central Government employees, for restoration of democratic rights.Trade Union movements and its workers all over West Bengal are perpetually subjected to violent attack by the hooligans abetted by the leaders of ruling party of the state. Such attacks are often accompanied by repression of state police force. Central Government Employees movement being part of Trade Union movement is also bearing the brunt of the wrath of ruling class and state administration.In 2011 when a union backed by the ruling political party tried to capture a Union office of Confederation affiliate at Nizam Palace, Kolkata, by force, leadershipof C-O-C West Bengal (State union of Confederation) rushed to the venue to protest. A few employees who are the members of parallel union, supported by hundred of outsiders of ruling party, attacked our comrades with iron rods and bamboo sticks. Secretary of Confederationaffiliate, i.e; CPWD workers Union and one activist of the union suffered multiple injuries including head injuries. They had to be admitted in intensive care unit of a hospital and after untiring efforts of some doctors their lives could be saved. Four C-O-C members were also severely beaten up. General Secretary of the C-O-C was also not spared. Police framed cases against our comrades under charges of rioting, carrying deadly weapons, causing injury etc. However, with the firmness of the Union activists Union office could be retained.Beginning with this, there have been innumerable incidents of attacks and intimidation. No strike at the call of CentralTrade Unions or Confederation could be observed without violent attacks. Postal employees in the districts are worst sufferers. Employees living near post office are forcefully brought to work place by police and the cadres of ruling party. In one case after police broke open the door of a post office at Belghoria, North 24 Parganas, which was closed due to 100% strike, lady Asst. Postmaster was ordered to work. As she refused to break strike shewas badly beaten up in broad day light.Our comrades, especially Gramin Dak Sevaks in villages are compelled to leave their houses as they are supports of left forces and carrying red flags of their union. Attacks were made on the Conferences of Postal Union and Pensioners Associations in various placesincluding Kolkata. The displaced comrades could not attend office and are forced to go on leave. Some of the GDS had to face disciplinary action for continuing on leave beyond 180 days.Now-a-days local political leaders are intervening in administrative matters like transfer and posting etc. Many Divisional Superintendents are meekly following the orders of ruling political party leaders in this matter. Further, at the instance of such leaders, NFPE members are proceeded against in some cases as subsidiary offenders while primary accused are helped to find escape-route.During the last two days strike at the call of Confederation, outsiders carrying flags of ruling political parties attacked striking employees at Geological Survey ofIndia Head Quarter and Ayakar Bhawan (Income Tax office) at the heart of the city.Recently some followers of ruling party working in Botanical survey of India office, failed to get recognition of their union as they could not muster the support of more than five percent of employees. This enraged the political leadership and the followers of one Minister of West Bengal Government who is regularly raiding the Botanical Garden at Howrah District to intimidate the employees illegally entered the Garden and torn flags of BSI Employees Associations and fixed their political party’s flag in the office premises, threatening and abusing our employees.During the previous one day strike of Confederation and two days strike of Central Trade Unions attacks were launched by ruling party hooligans at Barrackpore, Kalyani, Contai, Tamluk and few other places where striking Postal comrades were manhandled. In Barrackpore sub Post office the Sub Postmaster was made to wear a garland ofshoes and abused. The same was propagated through electronic media in order to defame not only that particular comrade but also all strikers. Comrades who are manhandled during strike cannot file police case as they were afraid of being arrested by police on false charges.Administration especially in Postal Department taking advantage of the situation are harassing and issuing chargesheets against NFPE activists. The Appellate authorities also suo-moto reviewthe penalties and impose severe punishments. Three comrades are awarded compulsory retirement. Those three cases were for launching demonstrations. Attempts are being made to change union by way of intimidation and threats by supporters of ruling party. Inspite of it, most of the new recruits are enrolling in our union only due to the sustained effort of our comrades. Ruling party leaders are intervening in the internalaffairs of the Postal Administration to get our leaders transferred out of station. The common employees, especially lady employees are being transferred to inconvenient places and after putting them in trouble the transfer orders are reversed if the employees join unions supported by ruling party.It is in the above background Confederation has taken a decision to extend full support and solidarity to West Bengal comrades. NFPE calls upon All India/Circle/Divisional Unions to implement the call in true spirit all over thecountry. Let us tell our West Bengal comrades that they are not alone and the entire Postal fraternally is with them.

PIB NEWS -- IN LOK SABHA TODAYSmall Saving Schemes for the benefit of all including Weaker Sections of SocietyThe Small Savings Schemes that are currently in operation in the country are: Post Office Savings Account, Post Office Time Deposits (1,2,3 & 5 years), Post OfficeRecurring Deposits, Post Office Monthly Income Account, Senior Citizens Savings Scheme, National Savings Certificate (VIII-Issue), National Savings Certificate (IX-Issue) and Public Provident Fund.The above accounts can be opened by a person who has attained the age of majority and is of sound mind, except the Senior Citizens Savings Scheme which can be opened by a retired person who has attained the age of 55 years or 60 years on the date of opening of account. The accounts can be opened by an individual and the guardians on behalf of minor also.Benefits of small savings schemes are equally available to all persons which include weaker sections of the society.With the objective of facilitating payment of various Government benefits transferred under different schemes of Central and State Government, a new category of savings account called ‘Basic Savings Account’ was notified. An individual adult and also a guardian of any minor, including people from the weaker sections, whose names are registered for any Government Welfare Scheme, may avail benefits from the said schemes. Theycan open Basic Saving Account, without depositing any amount, in any post office for the said purpose.This information was given by the Ministerof State for Finance, Smt. Nirmala Sitharaman in written reply to a question inLok Sabha today.
